How long after submitting documents for adjustment of status should an EB-5 investor receive receipt notices?

I submitted my EB-5 I-485, I-756, and I-131 to a lockbox on April 5, 2023. However, I still have not received the receipt notices and the cashier”s check has not been cashed. It has been about 3 weeks now. When can we expect notices? If I do not receive it in 30 days, what is the next step? Also, I am on a K-1 visa and my I-94 will expire this month. Will this be an issue?

Receipts for EB-5 cases have been slow. If not here within 4-5 weeks of filing, you can inquire at the Lockbox email with evidence of your courier delivery information. The K-1 requires you to marry within 90 days of entry. Will you be filing a second I-485 through your spousal relationship? If no, you may wish to have the I-129F withdrawn.

While it is not uncommon for these receipt notices to take a few weeks, it sounds like there may be an issue in your case. Without looking at the filing, I cannot say what it was (it could be that you submitted the old government fee amounts or failed to attach a required document), but if the filing does not get accepted, it will be returned to you. My recommendation would be to set up a consultation appointment with an experienced immigration attorney to understand where the problem may lie.
