How can E-2 visa holders (through spouse) work in the United States?

Is it necessary to apply for an EAD in order to work if I am on E-2 spouse visa? My I-94 will expire in Jan. 2024. What other options do I have?

An E-2 spouse may work incident to status. Your entry document should say E-2S.

E-2 spouses can work incident to status, which means they simply have to be present in the U.S. in valid E-2 status and they are eligible to work without an EAD.

It appears that E-2 spouses can work in the U.S. without a work permit, incident to status.
