Does it have to be the same type of project for redeployment?

I do not quite understand one of the policy highlights of EB5 redeployment – Provides that further deployment must be through the same new commercial enterprise. If I invested in a real estate project, when it comes to redeployment, does it have to be another real estate project or it can be other types of projects such as hotel projects for example?

The EB-5 policy manual states that funds may be further deployed into any commercial activity that is consistent with the purpose of the new commercial enterprise to engage in the "ongoing conduct of lawful business," including as may be evidenced in any amendments to the offering documents made to describe the further deployment into such activities, as long as within the Regional Center''s geographic designation. So, look at what is allowed under the company operating agreement and see if it may need to be amended to allow for further deployment in a hotel.

There is no requirement that the redeployment of capital must be in the same industry or investment type. The requirement is that the invested capital must be sustained at risk for the sustainment/conditional period.

The redeployment does not have to be in exactly the same business.
