Does buying company stock through an LLC qualify as direct EB-5?

I want to do direct EB-5. I heard that the investment must be into a “new” business. There is a gas station under construction (90% work done and 10 % work pending) that I am interested in acquiring its stocks. My plan is first to establish a new LLC, then invest $800,000 in the new LLC. I would acquire 100% stock of the gas station with the LLC. Then the LLC will create 10 new jobs. Would this qualify as a direct EB-5 investment? Or should start from scratch?

It’s always best to start from scratch and work with your team to ensure an eligible investment. The project you describe may qualify if structured correctly.

This approach is likely to work. Speak with an attorney.
