Why is there a delay in the transfer of my approved EB-5 petition to the NVC?

My I-526 petition was approved in the first week of July 2020 after 28 months. I am yet to receive my Welcome letter from NVC. When I enquired at NVC they replied that the case is not yet transferred to NVC from USCIS and in their inquiry to USCIS, they got a response that the approved I-526 is under review. What is happening with my petition? I have a child who is at risk of aging-out and I need to pay the visa fee at the earliest. What can be done to get my petition transferred to NVC?

The fact that the petition is under review is not good because they seem to be going through many cases to look for ways to revoke the approval. There are ways to seek to acquire and pay the fee bill manually and submit the DS-260 manually so you can freeze the child''s age.

It has been too long already. Is the child at risk of aging out even with CSPA? If so, your attorney should write a stern email to the USCIS regarding the unreasonable delay and violation of their duty to act under the APA and given them 10 days to act. If there is no action, you have got to get a judge''s help via a Writ of Mandamus.
