My I-526 was filed five months ago. I am investing in a regional center project that already has some approved I-526s. I am not Chinese. Although IPO publishes the average processing times, I am wondering what the realistic processing time for my case would be.

Immigration attorneysSince you have already filed your EB-5 petition on Form I-526, you are immediately eligible to apply for your immigrant visa or for adjustment of status upon its approval. The published average processing times are your best estimate of when your case will be approved, although realistically some will be approved sooner than that date and some after that date. There is no way to tell.

Immigration attorneysThe average processing time for I-526 petitions is about 12-18 months, assuming you do not get a request for evidence which may further delay the processing of the case.

Immigration attorneysAnticipate 16-18 months based on the current adjudication times. Hopefully, these wait times will improve.
