Can my relatives be part of the 10 jobs in the EB-5 investment?

In case I invest in my cousins’ business as my direct EB-5 investment, would it be possible for them to be part of the 10 jobs? They are U.S. citizens (they were born in the U.S. but their mother is from Bulgaria, where I am from). I would be applying with my husband and child, and we would like to employ my husband as well, but he has no U.S. citizenship.

Hi, yes, you can employ your .US.C cousin, and he can be counted as one qualifying employee if he works for at least 35 hours a week for at least the minimum hourly wage. Only EB-5 investor's spouse and children cannot be counted as qualifying employees.

Investor and her/his immediate family members are not qualifying EB5 employees (i.e., do not count toward the EB5 job creation); everyone else who meets the EB5 definition of a qualified employee counts. The best advice anyone can give you is to retain a qualified immigration attorney to advise you.
