I recently got laid off while on a work visa. I would like to remain in the U.S., so I wonder if I can use 401K funds to invest in the EB-5 visa.

You can but unless you are in the U.S. in a valid nonimmigrant category you are not eligible to file the I-485 to remain here.

401 K is your fund. USCIS does not prohibit using legally earned funds for EB-5 purposes.
