I want to do a construction project myself by renting a regional center. I need to be in the U.S. to do the construction. What are my options to stay legally and manage the construction? Can I wait for the I-526 to be approved, apply for I-485 and then move to the U.S. and then start the construction project?

Find an EB-5 Visa Lawyer: Immigration AttorneyUnfortunately, the I-526 does not allow for concurrent I-485/Adjustment of Status filings. Long-term immigration planning is important, and an immigration attorney will be essential. One quicker path to entering the U.S. to work is the E-2 visa, provided you are from the right country and are intending to stay temporarily.

Find an EB-5 Visa Lawyer: Immigration AttorneyThere are entities and regional centers that are willing to affiliate with a good EB-5 project under the right circumstances. You should reach out to an experienced EB-5 attorney who can advise you. As for options to stay in the United States and manage a construction project, the pending I-526 petition will not allow you to do that. You could enter as a B-1 visitor for up to six months (with a possible six-month extension maximum) for temporary business purposes, but not for employment.

Find an EB-5 Visa Lawyer: Immigration AttorneyYou should get an interim visa to stay in the U.S. to manage your project. Your options depend on your country of nationality and the specifications of the project.

Find an EB-5 Visa Lawyer: Immigration AttorneyYou can likely find a regional center to rent but you will need to find another way to enter and work in the U.S. such as an E-2 treaty investor if you come from an eligible country.
