Can I include dependents in my I-829?

My conditional permanent residency was approved in November 2018, but my son”s I-485 got an RFE and was eventually approved in April 2019. I am now going to file an I-829. Can I include my son in it or do I need to file for him separately?

It is best to include all children in the petition.

If still a minor you can include him because he was approved within six months of your approval.

You should include your dependents on the I-829 Form because such information is required. It is likely, however, that he will have to file a separate I-829 since he received his conditional green card more than six months after you received yours.

You should include all derivative family members in the I-829, including the son recently granted the two-year conditional resident card.
