My wife and I had our I-485 applications approved based on my EB-5 I-526 petition. She has a child from a previous marriage, and the child was under 18 years old when we got married. I would like to file Form I-824 to allow the child to obtain an immigrant visa in his home country, based on our stepparent-stepchild relationship.
The Form I-824 instructions state that a green card holder may request that their child follow to join them in the U.S. based on the approval of an I-485 application and an employment-based visa petition (Form I-140).
However, I obtained my green card through Form I-526 under the EB-5 program. Am I eligible to have my stepchild follow me to join me?
