Can I file for EB-2 NIW if I am a conditional permanent resident?

My EB-5 project seems to have some problems; I don’t see a very big possibility it would be approved even if I file an I-829. Should I still file it? Could I apply for EB-2 NIW if I meet the requirements?

Yes, you can file an EN-2 NIW as a backup but switching is complicated.

Yes, but you will be required to abandon your CPR status to get a green card based on EB-2 NIW if approved. File I-829. Consult an experienced immigration attorney to review your options.

Yes, but you will need to abandon your conditional resident to get a green card on the new basis at the later stage.
