Can I file for EB-2 NIW if I am a conditional permanent resident?

My EB-5 project seems to have some problems; I don’t see a very big possibility it would be approved even if I file an I-829. Should I still file it? Could I apply for EB-2 NIW if I meet the requirements?

Yes, but you will need to abandon your conditional resident to get a green card on the new basis at the later stage.
