Can I apply for EB-5 while in the U.S. on a B-2 visa?

Between Sept 30, 2026, and Sep 30 ’27, can I apply for an EB-5 while in the U.S. on a B2? Or must I return to my home country/Australia to file EB-5?

If you did not have intention to stay when you entered, and apply only a few months after entry, you may be eligible to file to adjust. But if the program is not extended, you may not get adjudication ad the application would most likely be denied.
