Can attorney's fees be counted towards the EB-5 visa minimum investment requirements?

Can fees like attorney''s fees and others be counted towards the $500,000 minimum EB-5 investment amount? Or are they excluded from the amount?

    The foreign national must invest the minimum EB-5 investment amount in a "new commercial enterprise" as defined in the pertinent federal regulations. As a result, attorney''s fees paid by the foreign national cannot be counted toward the minimum investment amount.
