How can a new dependent be added to a pending Form I-829? My mom applied for Form I-829 in 10/2024. I (her daughter) recently obtained a conditional green card in 08/2026 through a follow-to-join I-485. Is it possible for her to add me as a derivative so I can join her pending I-829?

EB-5 Immigration attorneysUsual rule is your expiration date must be within 6 months of hers, or else you need to file your own I-829 at the right time.

EB-5 Immigration attorneysYou will not be able to add an additional dependent to the pending I-829. Instead, you will need to file your own I-829 based upon your mother's case. On page 1, Part 1, Question 5, you need to select the checkbox. On page 2, Part 2, Question 11 of the form, you need to provide your mother's I-829 case number so it can be linked.
