The recent court ruling places the renewal of I-829 petitions at the center of the EB-5 landscape, amid a significant increase in denials by USCIS.

When final action dates to progress, it indicates quicker processing of applications, reducing waiting times and increasing visa availability.

The revised charges are now visible on the USCIS website, with the amounts having returned to pre-April 1, 2024, when all EB-5 fees increased greatly.

The proposal would require nearly all non-U.S. citizens to take a photograph upon entry. It is open to public comment until Nov. 26, 2025.

Immigration organizations caution about potential delays, given USCIS’s current processing backlog.

If approved, dependents could file an I-829 independently if the EB-5 investor dies or abandons their petition but would have qualified for the visa.

The proposal acknowledges that the reduced EB-5 fees will improve processing and reduce the current backlog.

The heart of the issue is the delay in paying the rest of the money, not the use of partial payment per se.

The H-1B program has been under much scrutiny since the second Trump Administration took office in January.
