
In the November Visa Bulletin, the second of the 2026 fiscal year, the Department of State (DoS) kept the EB-5 final action and filing dates the same in the Unreserved and set-aside application categories.
For Indian petitioners who are Unreserved, the Final Action Date remains Feb. 1, 2021. The filing date for Indian applicants stood at Apr. 1, 2022.
Meanwhile, Dec. 8, 2015, remains the final action date for Chinese EB-5 applicants in the Unreserved category. Their filing date remains July 1, 2016.
Both dates for applicants from the Rest of the World (ROW) countries in the EB-5 set-aside categories and the Unreserved EB-5 visa remain current.
There is also no sign of a backlog in set-asides that the DOS cautioned in early 2025.
