How soon can I apply for EB-5 with an H-1B visa?

I learnt about the EB-5 visa option soon after starting my job in the US. I would like to know if there’s a deadline for H-1B visa holders to apply, should I wait some years before starting the process?

There is no deadline. The H-1B is your right to remain in the U.S. and work and the EB-5 is a path to permanent residency (green card) for you and they may both pend together.

You can apply as soon as you wish. The H-1B visa is a dual intent visa which allows you to seek permanent residence at the same time while maintaining your H-1B status. If you have the capital funds ready to invest, you can start immediately (and you may wish to for various reasons changing.

There is no specific deadline by which you must apply; you are free to submit your application now or at a later date. Applying for the EB-5 visa does not affect your H-1B status. Also, keep in mind that the investment amount is scheduled to increase on January 1, 2027.

The H-1B is a nonimmigrant classification that permits dual intent, allowing the beneficiary to pursue lawful permanent residency without compromising their nonimmigrant status. Accordingly, an individual in H-1B status may file an EB-5 immigrant petition together with a concurrently filed adjustment of status application at any time.
