The EB-5 business plan I am looking at involves an American food restaurant as part of the investment. Does a restaurant qualify as an EB-5 project? Must changes to the restaurant down the line affect the application process?

EB-5 Immigration attorneysRestaurants can indeed qualify as EB-5 projects, whether through direct standalone investments or as part of a regional center. For direct EB-5 investments, the project must meet key criteria, including investing the required capital and creating at least 10 full-time jobs for U.S. workers within two and a half years. For restaurants, these jobs can include positions such as chefs, servers, and managers, and the job creation can often be direct.
If the restaurant is part of a regional center project, indirect and induced jobs generated through economic activity related to the project may also count toward the job creation requirement, depending on the economic model used. Working closely with an experienced immigration attorney and a qualified economist is essential to ensure compliance and mitigate risks associated with changes in the business.
