When is a status extension given to the dependents of an EB-5 investor?

After the filing of the I-829, when will the dependents of an EB-5 investor get the “Verification of Inclusion of Dependent” (an extension of status for one year)? How can the applicant and their dependents come back to the United States for biometrics if their green cards already expired and they could not get the status extension letter?

As you have stated, there is the issuance of receipt notices of the I-829 filing and this will allow the re-entry of the investor and dependents to the United States.

I would file for biometrics and obtain a receipt from USCIS, as well as a receipt for your request for extension. Then go to the U.S. consulate in your country and request an appointment with the visa officer to request a visa.
