What is the future of the tenant occupancy methodology?

Does anyone know what happened to the Carlsson et al v. USCIS case that used the tenant occupancy methodology? Also what''s the future of this methodology?

    The use of tenant occupancy could be counted as indirect jobs. An experienced EB-5 attorney and an economist will determine if indirect jobs will be created.

    On the basis of a Regional Center EB-5 project which has tenant occupancy, with the correct economic methodology and market feasibility analysis, the required indirect jobs can be calculated. An experienced EB-5 attorney and economist will be able to determine in a first brief analysis if the required indirect jobs will occur.
