How can I work with a U.S. EB-5 attorney while in my own country?

I am in Pakistan. Will it be possible for me to liaise with a U.S. EB-5 immigration attorney from my country? Or will I be required to visit the United States to start my application if I hire a U.S.-based immigration attorney?

You do not have to come to the United States to start working with an EB-5 attorney. We work with clients located all over the world via emails and telephone calls. The key would be to finding an attorney who will respond to you quickly and explain things so that you could make an informed decision.

Most EB-5 investor clients work from abroad with attorneys in the United States. There is no requirement that you physically visit the United States before you start the preparations for your I-526 petition.

To work you need a separate work visa. As a Pakistani national, you may be eligible for an E-2 treaty visa.

You should not have any problem working with a U.S.-based EB-5 immigration attorney from your home country. An attorney will do most of the work for you to prepare and file your I-526 petition and direct you on what documents he or she will need from you to prepare your case, most of which you may easily provide electronically to an attorney.

U.S. attorneys, in particular immigration attorneys dealing with EB-5 cases, frequently represent clients living abroad. Most documents that are required can be scanned and emailed. Conferences can be arranged by phone or other internet-based means. Where original documents are required, these can be sent by courier. My firm and many others in the United States work with clients overseas. While a meeting is certainly a good thing, you can speak with prospective counsel over the phone or video conference. And of course, email makes communication easy as well. You will have to sign a retainer with a U.S. law firm and send it back to the law firm either by email and/or overnight mail.

This should not be a problem if your investment immigration attorney is experienced with working with overseas clients. We have extended hours to meet the time differences. We work with many clients that we meet in person for the first time when they arrive in the United States.

We successfully file EB-5 applications all the time for people in other countries. Merely filing an EB-5 does not give you any right to come to or stay in the United States while the application is pending. You would need a visa (tourist/business/or other) to visit here.

You may use the internet. I have a client from Pakistan who works in Saudi Arabia. I have advised him on EB-5 and he is currently involved in a project. I have another client, a National of India working in Dubai and he has engaged me to find a suitable investment project. So you need not be physically in the United States to start your application.

I work with many clients around the world who are not able to ever visit me in my office. You can submit nearly all of the materials for filing via e-mail or secured file exchange. The only originals I should need for your initial filing will be the signed government forms, which you can courier back to me by mail.
