I appllied for I-829 to remove conditions on my green card in June 2018. The application is pending. After Covid, I was laid off and registered for unemployment insurance. I am receiving the insurance and COVID money on weekly basis. Could this be treated as publiic charge? What may happen to my I-829 application?

Find an EB-5 Visa Lawyer: Immigration AttorneyGenerally, while it is unfortunate occurrence, it should not be a problem. Based on previous experience, it has never been a stumbling block for approval of I-829.

Find an EB-5 Visa Lawyer: Immigration AttorneyThe public charge rules do not apply to permanent residents (conditional or unconditional). Also, Unemployment insurance alone should not be considered a factor in a public charge evaluation by a USCIS officer. Not having a job and/or receiving public means-tested benefits would be considered a factor in a determination for someone applying for permanent residence, but other factors, such as a solid sponsor on Form I-864, could overcome the public charge ground.
