What can I do to make USCIS send my approved EB-5 case to the NVC?

It has been more than 6 months since my case was approved and yet I have not heard back from NVC. When I mailed them recently with my I-797 they said that USCIS has not sent them my case. I understand that the Eb-5 regional center program has lapsed but visa bulletin chart B is still current so I should still get my visa bill and request for DS-260 because my child is at the cusp of aging out. What can I do?

It could be because your priority date is not current, meaning there is no visa available. You can check the visa bulletin to know for sure. You should check back with your immigration attorney.

Call USCIS and confirm it was sent, and get details to discuss with NVC.

Keep pushing the Immigrant Investor Program Office to transfer the file. Technically you can file a mandamus to force them but it seems a little extreme. You could also reach out to your congressman and see if they will submit an inquiry. If there is a legitimate age-out issue, that is itself a basis to expedite.

Was it a Regional Center case or a private individual investment?
