We have submitted our EB-5 application in Sept. 2019. I have been trying to find out how long it takes for a case to open after filing, but I am getting mixed answers. When should I expect to hear about my case?

Find an EB-5 Visa Lawyer: Immigration AttorneyYou can always check the status of your case on the USCIS website. Find “Check Case Status” and you can see USCIS processing times. Currently, it is taking over 54 months for USCIS to adjudicate Form I-526.

Find an EB-5 Visa Lawyer: Immigration AttorneyThe USCIS status website will only confirm that your case has been received, has been issued a request for evidence, has been approved, or denied. Processing times are still very slow - anecdotally, I am aware that some cases filed in early 2019 have been approved over the last month. It is difficult to predict USCIS adjudication patterns - suing USCIS via a mandamus action is the one way to really push USCIS to adjudicate your case on a more predictable timeline.
