Who can apply for the EB-5 program?

I am a 68 year old retired doctor from the United Kingdom. My wife and I are considering obtaining U.S. permanent residency, with the goal of eventually getting our citizenship, and we have heard of the EB-5 program as a possible option. We are wondering if there is an age limit for EB-5 eligibility, and if my retirement would disqualify me from applying? Who is allowed to apply for the EB-5 program?

Age makes no difference. Retirement has no effect, certain investment projects require that you satisfy the definition under SEC rules that you be an "accredited investor." I am not aware of any age limitation on EB-5, and in fact, many people from overseas are using the program as part of their retirement plan. I do not know how all of this affects your eligibility for U.S. health and pension benefits. What this means is that you should not only get U.S. immigration AND securities counsel to handle EB-5 matters, but you should also speak with someone about estate planning, tax planning, and non-EB-5 investment management and transition as well.

You should be allowed to invest in a business or in a project with a regional center to obtain permanent residency status. There is no age limit. Your retirement funds should be considered as "legal sources" of investment funds if you can document them.
