Who am I allowed to contact about a potential EB-5 investment?

My client has $2 million to invest in a hotel/real estate EB-5 project. Who am I allowed to contact in the EB-5 industry about their investment? Can I reach out to developers/regional centers directly? Are there any special regulations I have to follow?

You should be able to contact anyone on behalf of your client.

If you are the investor or you represent the investor, you could contact potential issuers/developers/regional centers and perform the necessary due diligence to determine if an EB-5 investment is right for the investor, and if so, which one. As an issuer of securities, the developers and regional centers have SEC requirements about how they offer their securities, to whom and where they offer them. There are no similar SEC restrictions on investors looking to invest.

The regulations regarding the marketing of EB-5 opportunities affect the offeror, not the offeree. If your client is interested in EB-5 investments, he or she (or you on their behalf) can reach out to regional centers for information.

You may reach out to anyone as part of your "due diligence" on behalf of your client.

There are lots of regulations governing prospective investors in the United States. However, you can reach out to regional centers to inquire regarding possible projects, especially if the investor is abroad.
