Which EB-5 professionals will a regional center provide for me?

If I invest through an EB-5 regional center, which professionals will I have to hire for the whole process? Will the regional center provide certain professionals and I'll just have to find my own immigration attorney?

    If you invest with a regional center, you should hire your own immigration attorney. The immigration attorney should represent you in your immigration matters. You may also want to hire an international tax advisor and a financial analyst/business due diligence expert. These professionals typically are not provided by the regional center and they should be independent from the regional center anyway.

    It is highly recommended that you hire an independent EB-5 immigration attorney before you start the process of due diligence to select a regional center project to invest in. Your attorney would be able to perform legal due diligence and recommend other professionals needed in your case, such as investment adviser, CPA, etc.

    This depends of the particular EB-5 regional center project you are investing in. Some projects have a list of recommended attorneys, while others leave it entirely up to you to find legal counsel. Further, you may wish to obtain a registered investment adviser to assist with selecting an EB-5 project. I would also advise that you speak with, and retain an immigration attorney before selecting any particular EB-5 project. Your immigration attorney should be able to assist with immigration due diligence.

    When you invest with a regional center, I suggest you find an independent immigration attorney who will represent for your interests only. If you are not sure about the profitability or sustainability of the project, you may also want to find someone who can provide investment advice to you.

    It depends. A regional center may have a team of preferred professionals, but they probably will not (and definitely should not) require you to use any specific professional for your representation.

    Generally, the regional center will provide you with an approved list of attorneys who they feel are qualified. It the attorney recommended is also the attorney for the regional center, you may be concerned about a conflict of interest. You should know that any attorney that you select represents you as your attorney, not the regional center. This attorney is there to assure your interests are protected.

    It depends on whether you are working with an experienced regional center or one of the many that have recently sprung up. Many of the new ones do not have established networks.

    You need to hire an independent immigration attorney for filing an EB-5 petition. It is important to have a due diligence report for the regional center project on immigration law and structured finance. Your attorney will also help you document and explain source of funds. You should try to find out whether the attorney you are working with gets compensated by the regional center. If yes, there is an inherent conflict of interest.
