When should a potential EB-5 investor choose an immigration attorney?

I am considering relocating to the United States through EB-5 investment. Should I choose an immigration attorney before or after I pick a regional center? Can I pick an attorney now and then change to a different one later? Does this usually cause a delay?

Immigration attorneys can (and should) assist you with immigration due diligence on a regional center and project, so retaining them as early as possible is good. They can also assist you with the overall process of immigration, and any alternative processes that may be available to you.

You should hire an EB-5 immigration attorney in the United States before you invest in a project within an approved regional center. He or she will be able to analyze the project's offering documents for you before you sign and invest as well. I recommend hiring an attorney with significant experience in the EB-5 field.

You always have the choice to change lawyers. However, you should select an attorney in the beginning to help you with the due diligence when selecting a regional center or project.

You should choose the attorney early so that you can get guidance/advice on every step of the process. However, if you are contemplating changing your mind and changing the attorney, then you may get conflicting or different advice that could confuse you and delay the process. Choose an attorney with significant EB-5 experience who has seen changes that occurred in the program over the years and could react efficiently to any recent changes or upcoming ones.

I would choose one now to help you perform immigration due diligence in selecting a regional center project. You may then choose another attorney to represent you in filing the application if you wish. You specify in the fee agreement the work you want the lawyer to do for you.

It is a good idea to retain both immigration and securities counsel early in the process, as the paperwork is quite complicated and having counsel along the way will make things run more smoothly. Having securities counsel working with your immigration counsel is recommended so that you are fully aware of the mechanics of the transaction and that someone has reviewed deal documents from a securities law standpoint.

You should definitely choose and hire an immigration attorney who specializes in EB-5 matters BEFORE you invest and select a regional center. Competent immigration counsel who understands how EB-5 projects are structured will be invaluable to guide you in selecting the right project. EB-5 projects are not solely about your investment; they also are structured to hopefully provide the necessary job creation to meet the EB-5 visa requirements. An immigration attorney can help you to sort out the projects that have different risk levels pertaining to the methodology of the forecasted jobs being created.
