What is the average EB-5 preparation time frame?

How long does it realistically take to prepare for an EB-5 regional center petition from the standpoint of an investor? If I have the required $500,000 ready in my bank account and the transfer would not take more than 2 weeks, when could the attorney submit the I-526 petition on my behalf? What documents could take time to obtain for me?

    The preparation time varies case by case. It takes time for the investor to collect the documents to prove his/her legal source of funds. Sometimes the documents involve bank statements of the past five or more years; sometimes a certain document is not readily available and it will cost a lot of time of the investor to retrieve the document. Talk to your EB-5 attorney to get a realistic estimation based on your specific case.

    There is no typical fixed time limits or deadline for submission. One of the few documents that may cause delay is the documentation process of the source of funds. Investors are required to show their investment funds came from legal (lawful) source(s). Advisably, consult an EB-5 attorney for guidance.

    The time frame depends on the number of sources of the investment funds as well as the availability of the required accompanying documentation. Once all required documents are gathered, an I-526 application can be filed in less than two weeks.

    Have you already picked a regional center/project? If so, then SOF could be done in the two weeks it takes you to wire the funds.

    The prep time for I-526 would depend of the complexity of the source of funds (SOF) scenario. That you have the $500,000 ready to go is not determinative. Where it came from is critical. It usually takes about 30 days to put the SOF documentation together and prepare the 13-page I-526 petition itself.

    How quickly an attorney could prepare the I-526 petition to file for you depends on that attorney's experience and the caseload. I have filed petitions as quickly as few days after receiving all the documents we requested from the investors and regional centers. Normally, I strive to file the petition within a month of receiving the documents.

    The length of time it takes to prepare and file an EB-5 investor petition on Form I-526 would depend. If you are working with an experienced attorney who has experienced staff and you are investing through an established EB-5 regional center project, the attorney should have the capability of preparing and filing the EB-5 petition in a relatively short period of time. It would certainly be within two weeks. However, the attorney cannot do so unless and until he or she has all the necessary information required to prepare the EB-5 petition.

    Typically, it takes about four weeks to prepare an I-526 filing. However, depending on your source of funds and availability of documents, it could take as little as one week or several months to prepare. It is best not to transfer the funds until your attorney has reviewed your source of funds documents. You want to be aware of any risks/issues with your source of funds prior to making the investment. In my experience, while documents that need to be translated into English take the longest to obtain, it is case or country specific. For instance, a document from India could take one or two days, but the same document from Vietnam may take one week and from Iran it may take months.
