What fees should be taken into consideration when preparing for an EB-5 petition?

I am a potential EB-5 investor and am evaluating the cost of the whole process. Apart from the $500,000 (TEA) investment required for an EB-5 regional center project, what other fees are to be taken into account? How much do they normally range in?

You will need to budget for: a regional center syndication or subscription fee, which may range from $30,000 to $60,000; attorneys fees that range from firm to firm; a USCIS filing fee, currently at $3,675; and translation costs for documents in the language other than English.

You should budget for the USCIS petition filing fee ($3,675), attorney fees (ranging from $20,000 to $50,000), regional center fee (ranging from $30,000 to $50,000), etc.

The other fees are attorney&#39s fees, an administrative fee to the regional center and filing fees to USCIS.

When one invests into a project under the auspices of an EB-5 regional center, there are a number of costs. In addition to making the minimum $500,000 investment, all of which must go directly into the EB-5 project, there will be a number of other costs. The costs are primarily the administrative fee charged by the regional center in order to cover certain expenses, including the referral fees paid by the regional center. The administrative fee will be approximately $50,000. In addition, there will be legal fees paid to the attorney representing the individual EB-5 investor. Those fees will vary somewhat but are separate and apart from the administrative fees. In addition there will be certain other expenses that will be paid, including the filing fee paid with the EB-5 petition on Form I-526 as well as certain expenses paid at the time the immigrant visa is applied for through the American consulate or, if the individual is in valid status in the U.S. and otherwise eligible, through adjustment of status within the U.S.

Most regional center offerings also require a syndication fee, sometimes referred to as an "administrative fee." These fees typically range from $30,000 to $60,000. There is also the attorney&#39s legal fee, which varies from firm to firm, and the USCIS filing fee for an I-526 petition filing, which currently is $3,675. You also should expect to pay for translation costs, if any of your documents are in a language other than English. Finally, depending on whether you adjust status in the United States or apply for an immigrant visa processing abroad, there are different application or filing fees per person.

It depends on the project in which you are investing, as well as who represents you.

The regional centers normally charge $50,000 to $60,000 for their administration fees. You will have your own legal fees (attorney fees) for the I-526 immigration petition, DS-260 immigrant visa application and I-829 removal of condition application process, which runs from $20,000 to $30,000. There are government filing fees for each of the above steps, totaling approximately $8,000.

Assuming you are like 95 percent of the EB-5 investors and are selecting a regional center-sponsored project, a significant additional cost is the administrative fee of the regional center, which is typically $25,000 to $60,000. USCIS filing fees for the entire process are in the $10,000 range for the principal applicant. Legal fees vary wildly as well, depending on a variety of qualifying factors of the attorney or law firm chosen.

There will also be the regional center&#39s administration fee, your immigration attorney&#39s legal fee and the U.S. government&#39s filing fees. Those additional fees combined should be in the range of approximately $75,000 to $85,000.
