What EB-5 professionals should be consulted before applying?

I want to apply through the EB-5 program, but I am unsure of how to get the process started. I know that I should hire an immigration attorney, but who else will I need to consult with? Do I need to hire professionals in my own country to help me or is it better if they are located in the United States?

The primary professionals include the experienced immigration attorney, companies providing due diligence and compliance reports, and international tax attorneys providing pre-immigration tax planning.

First and most importantly, immigration counsel, because this is an immigration process. You may wish to consult with a business or investment adviser and a tax professional. Since you are dealing with matters of U.S. law and policy, U.S. professionals should be retained.

I would find an attorney from the list of the American Immigration Lawyers Association (AILA) who has expertise in EB-5 applications and then let that person guide you as to what other experts you may need.

Start with one good U.S. immigration lawyer, and follow their recommendation as to the rest of the team.

It depends on whether you are doing your own project or investing in a regional center. There should not be any need for any professionals in your own country unless your source of funds is complicated and you would want an accountant to show the trail of money.

If you need help finding an appropriate EB-5 project or investment vehicle for you, you should consult with an investment adviser who is licensed to give you investment advice. You should also consult an experienced EB-5 attorney who has done these cases and knows how to guide you through proving your source of fund tracking. I would advise you to consult these professionals who are in the United States, as the EB-5 program is a U.S. immigration program and investment, as long as you are comfortable with English. Many of these professionals also have foreign languages capabilities for your convenience.

You should engage the services of an experienced EB-5 immigration attorney in the United States. An attorney would be able to refer you to trusted, experienced experts in the United States as necessary in your particular case, such as a licensed financial broker or other professional advisers.

You should engage an investment immigration attorney with a proven track record. Additionally, you should have a third party registered broker dealer provide you with independent due diligence before you risk your capital and the immigration future of your family.

You should hire securities counsel in the United States and immigration counsel in the United States independent from the regional center or EB-5 promoter to represent your interests. The securities attorney will assist in your due diligence on the transaction and the governing corporate documents. Immigration counsel would work in tandem with securities counsel.
