What are the overhead costs for an EB-5 visa?

I will make an investment of $500k for the EB-5 visa. What are the legal fees for the processing of this visa (government fees) and an estimated professional fee for the process?

How much should I be expecting to pay for both, direct investment and investment through a regional center?

Regional centers generally charge an administrative fee. The fee may range from $35,000 to $60,000. The filing cost of the I-526 petition is currently $15,000. Legal fees can range from $15,000 to $35,000.

Normally regional center will charge additional administrative/management fees. As for the filing fees, basically filing fee for I526 is $1500, for I485 is $1070 and for I829 is $3750. There are other fees involved as well. As for the attorney fee, you should consult with attorneys. Attorney fee is based on experience and knowledge, so it is quite different in this area.

The regional center investment is normally $500,000 and the direct is $1,000,000 unless in a qualifying area. Legal costs vary from $10,000 to $20,000 depending upon individual circumstances. I will be happy to discuss further.

Legal fees are negotiable. The USCIS filing fee for an I-526 petition is $1500. Direct investment EB-5 projects and regional center projects have the same USCIS filing fees, but may differ on administrative and other costs. When selecting an attorney, make sure you ask about experience and expertise in the EB-5 practice area, and not just about the legal fees.

Most Regional Centers have administrative fees in the $35,000 to $60,000 range. Attorney fees range from $15,0000 on up depending on what other services are needed.

It really depends. Some attorneys will assess a flat rate, others an hourly rate. If you invest in a regional center, then there may also be a syndication or subscription fee (which I have seen vary between $30,000 to $60,000). Some regional centers will allocate part of that fee to pay for your immigration attorney; others will not. If you set up a direct investment in a business that you will be managing, working at, etc., then you can expect to have various other fees above the cost of hiring an immigration attorney, such as fees for a business plan writer, a CPA, other business advisers, and other ancillary costs. You should speak with an experienced immigration to learn more about the legal fees as for antitrust reasons discussing legal fees in a public forum like this is not recommended.

Please note EB-5 attorneys charge fees for attorney services and advise and preparation of a petition and applications. The coats cover government filing fees, copies and postage or delivery services. For representation of an EB-5 investor in an EB-5 Regional Center project in obtaining conditional permanent residency and the removal of the conditions attorney fees may vary between $15,000.00 and $30,000.00. Based upon current government fees the total will be an estimated $6,500.00. While for a direct investment the attorney fees may vary from $35,000 to $45,000.00 plus costs. Please remember every case is different and hence fees will vary.

Attorney fees can vary depending on the attorney you speak to and the details of your U.S. immigration goals. Remember the saying "you get what you pay for" as experience in this type of representation is essential, but it will affect the fees. Regional center investments will also often have an administrative fee associated with their programs ($30,000-$60,000). Direct investments may require you to pay a business planner and economist yourself to prepare the business plan and economic report that would be prepared by the regional center otherwise.

If you invest in a business directly and want to manage day-to-day that business, there is no administrative fee associated with that business. With the regional center, there is usually $45,000 or more of administration fee that each regional center charges. As to the legal fees, I understand that most experienced EB-5 lawyers charge $15,000 - $25,000 and USCIS filing fee for I-526 is $1500 and Visa filing fee is $405 per person filing immigrant visa application.

The costs of an EB-5 will vary widely as the team of professionals typically associated with an EB-5 application charge different amounts for their work; however, you should probably expect to pay close to $100,000 additional fees to cover all the fees that will be due to various entities/individuals associated with the EB-5 process. 1. Attorney fees can be anywhere from $12-15,000 (for Regional Center) and upto $25,000 for Direct investment. 2. If working with a regional center, most centers charge what they call an "Administration Fee" and that is often about $10,000 (this is because, per the rules, the entirety of the EB-5 investment MUST be earmarked for the project. EB-5 center staff fees cannot be deducted from the Project amount, so Regional Centers charge an additional amount classified as "administrative costs" 3. A successful EB-5 application should also have the involvement of a professional Business Plan Writer, and an Economic Analyst, each of whom will charge based on their experience and rate of success.

You will have a USCIS filing fee of $1500. The legal fees can range from $10,000 to $30,000 depending on the particular case. The regional center will charge an administrative fee of approximately $45,000. I would recommend you meet with an attorney of your choice to review the alternatives and compare both the costs and advantages. Most attorneys will not charge for this service.
