How do I remove my child from the DS-260 Immigrant Visa Electronic Application?

Regarding the DS-260 application: I have separated from my spouse and we have one kid together. Do I have to fill out of my child application's online still? I no longer plan to bring him with me to the United States because he is a small child and I want him to stay with his mom. How should I proceed?

If your child does not intend to immigrate with you, you would want to properly disclose all information about your child even though you do not plan to bring him with you. All you need to do is answer the proper questions regarding your information and the fact that you have a child, but do not complete any portion showing that your child is an applicant for an immigrant visa as your dependent.

Your immigration lawyer should be able to notify the NVC on your behalf and remove any derivatives you wish to remove. He/she will have to attach the divorce decree with the custody agreement, giving your spouse the custody of that child; thus you cannot take the child out of the country without that spouse.
