Answer: 8 months. They are aiming at 3 months. Some cases do get adjudicated earlier than three months. There is no knowing and it is never certain how long cases take.

At present the average wait time for USCIS to respond to a I-526 petition is 8 months. If further evidence is required it can take another 3 months for a decision to be made.

USCIS processing times are fluid. At the May 2012 EB-5 stakeholders meeting, the Service noted that their target processing time for I-526 petitions is 4 months. However, it is currently taking 6-8 months to received a decision and it is unclear when processing times will decrease.

Unfortunately, nobody knows least of all USCIS. I''ve seen I-526 petitions approved in as little as two weeks and know that there are some petitions that have been sitting there at the California Service Center for far longer than a year.
