    Yes, EB-5 money can be a good source of capital for small businesses. We usually call it ‘direct EB-5’. First, you must make sure if your existing business qualify as a ‘new commercial enterprise’, which is a commercial enterprise: “Established after Nov. 29, 1990, or; Established on or before Nov. 29, 1990, that is: 1. Purchased and the existing business is restructured or reorganized in such a way that a new commercial enterprise results, or 2. Expanded through the investment so that a 40-percent increase in the net worth or number of employees occurs.” Second, you must know if the location of your business is within a targeted employment area (‘TEA’), which will reduce the investors; investment amount to $ 500,000 and make the investment more attractive to the foreign investors. If the business is out of a TEA, the investment amount for every EB-5 investor will be 1 million. Third, you should have a well-planned job creation schedule. Make sure each investor will get 10 new jobs credited to their investment. Direct EB-5 is very complicated. You may want to schedule a consultation with an experienced EB-5 attorney like us to further discuss the option.
