It is more difficult, unless you are a troubled business but it is possible if you restructure and reorganize the business.

In short, yes, you can use EB-5 investors to expand your business. I suggest both you and the potential investor set a consultation to review what limitations and restrictions there would be, and how to make it mutually beneficial.

Yes, you can utilize EB-5 Investor funding to increase your business; however, you need to be aware of the specific requirements under which the EB-5 Investor can qualify his investment to obtain his/her ''greencard'' when dealing with a pre-existing business.

That is possible (though it is unclear what you mean by "partners") and can be better set up through the so-called "direct method" of EB-5 investment rather than "regional center" EB-5 investment method. You should talk to an EB-5 service provider to explain the distinctions between the two methods to determine if it is right for you.

EB-5 investors may invest in your business and become business partners subject to your business falling under the definition of a ''new commercial enterprise''. For further information please contact Rahbaran & Associates.

You would generally need to conduct marketing efforts as you would when seeking regular investors. Helpful options might also be establishing connections with licensed investment brokers, immigration attorneys, migration agents overseas in order to attract potential EB-5 investors. It is important that you comply with applicable SEC regulations prior to engaging in soliciting investments and have a viable business plan that complies with applicable SEC/EB-5 regulations.

Yes, EB-5 money can be a good source of capital for small businesses. We usually call it ‘direct EB-5’. First, you must make sure if your existing business qualify as a ‘new commercial enterprise’, which is a commercial enterprise: “Established after Nov. 29, 1990, or; Established on or before Nov. 29, 1990, that is: 1. Purchased and the existing business is restructured or reorganized in such a way that a new commercial enterprise results, or 2. Expanded through the investment so that a 40-percent increase in the net worth or number of employees occurs.” Second, you must know if the location of your business is within a targeted employment area (‘TEA’), which will reduce the investors; investment amount to $ 500,000 and make the investment more attractive to the foreign investors. If the business is out of a TEA, the investment amount for every EB-5 investor will be 1 million. Third, you should have a well-planned job creation schedule. Make sure each investor will get 10 new jobs credited to their investment. Direct EB-5 is very complicated. You may want to schedule a consultation with an experienced EB-5 attorney like us to further discuss the option.
